What Is a Tax Lien on Property? County and IRS Claims

A tax lien is a claim for unpaid taxes against property or an owner. How county property tax liens differ from IRS liens and where to look them up.

What is a tax lien? It is a legal claim against property or against a taxpayer for unpaid taxes. On real estate, the two kinds people meet most often are property tax liens (or delinquencies) held by the county or city, and income or other tax liens filed by the IRS or a state revenue department. They are not the same process, and they do not always show up in the same index.

Property tax liens and delinquencies

Unpaid county or municipal property taxes usually create a priority claim against the parcel. Some jurisdictions treat delinquency as a lien automatically; others sell tax certificates or pursue tax deed sales after long nonpayment. The treasurer or tax collector’s records are the primary source—not the GIS popup alone.

Confirm the parcel and APN on the county viewer via our county GIS map directory, then look up the tax status with how to look up property taxes by address.

IRS and state tax liens

Notices of federal tax lien and many state tax liens are filed in the county land records against the taxpayer’s name. Search the recorder’s grantor/debtor index, then read the legal description or address on each notice so you do not confuse two properties owned by the same person. How to find liens on a property covers that workflow.

Clearing a tax lien

Deadlines and sale procedures are local. Call the tax office or a professional in your state before you rely on a third-party “tax lien” listing site.

What is a tax lien FAQ

Is a property tax delinquency the same as an IRS tax lien?

No. Local property tax claims are handled by the county or city tax office. IRS and state income-tax liens are separate filings, often in the land records by taxpayer name.

Can I see a tax lien on the GIS parcel popup?

Sometimes a balance due appears on tax sites linked from GIS, but many liens are only in the recorder’s or tax collector’s records.

What clears a tax lien?

Payment plus recording or issuing the release, satisfaction, or redemption certificate your locality requires.

Do tax liens wipe out mortgages?

Priority depends on state law and timing. Do not assume; get title or legal advice for a specific parcel.
