What a Top-of-Bank Call Means
A call to the top of the bank makes the upper edge of the stream bank the monument, not the water, not the toe of the slope, and not the center of the channel. The bank has to be identifiable. A gentle rise in a mowed field may not be the bank the deed meant.

An edge, if the ground still shows one
Deeds say along the top of the bank, to the high bank, or with the meanders of the bank. The monument is that physical edge. It is different from a thread call, which puts the line in the current, and from an ordinary-high-water call, which follows a water elevation. If the bank is a clear break in slope, a surveyor can follow it and monument angle points. If the ground has been graded into a lawn, the top of bank may be obliterated and has to be restored from older evidence, not invented at the edge of the flower bed. Flooding can cut a new bank suddenly. That new scarp may be avulsion’s scar rather than the called-for bank. You do not automatically move the deed to the fresh cut.
Meanders of the bank on a plat
A plat may approximate a winding bank with a series of courses labeled meanders of the top of bank. Those courses are a survey of the monument, and the monument may control if the courses and the bank disagree slightly. Priority of calls is the idea, and the facts matter. A gross error in the courses is a different story from a bank that has eroded. The plat should say whether the lot runs to the bank or to the courses as drawn. A table of meander courses is there to be read, not to be replaced by a smoother line you prefer. County GIS may snap the parcel to a hydrography line that sits in the channel. Stay off the slope
Do not walk the neighbor’s side of the creek to see their bank, and do not cut the bank to make a cleaner edge for a fence. A wheel rolled along what you think is the top is not a survey. A phone’s elevation profile is not a survey. If a fence is to be built on a top-of-bank line, a surveyor should locate the bank and file or deliver the survey your project needs. Until then, the call is a sentence to understand, not a line to occupy. Also check whether a drainage easement lies along the same bank. The easement can be wider than the deed boundary and can forbid the fence even when you own to the top.

The mix-up to avoid
Putting the fence at the water because the bank feels like part of the creek. If the call is the top of the bank, the slope and the water may be on the other side of the line, or in an easement, depending on the deed.

What is the toe of the slope, then?
The toe is the bottom of the bank, where the slope meets the flatter ground or the water. A call to the toe is a lower line than a call to the top. Substituting one for the other moves the boundary by the whole width of the slope.
Can a retaining wall become the top of bank?
A wall can replace a bank physically and still not be the monument the deed called. If the deed predates the wall, the wall is occupation or an improvement. A surveyor looks for the called bank. The wall does not rewrite the sentence.
